1. Introduction

Welcome to Patisserie Mon Amour. These Terms and Conditions (“Terms”) govern your use of our platform, which offers individual, one-on-one online pastry sessions, online and in-person group workshops, exclusive online masterclasses, and free recipes. By booking a session or accessing our services, you agree to comply with and be bound by these Terms.

2. Definitions

  • Service: The online platform connecting clients with professional pastry chefs for various instructional sessions and providing free recipe resources.

  • User: The person who books or participates in a session, workshop, or masterclass.

  • Instructor: Independent contractors (professional pastry chefs) who provide the sessions, workshops, and masterclasses.

  • Session: A scheduled one-on-one pastry class held online.

  • Workshop: A scheduled group session, which may be held online or in-person, for a collective learning experience.

  • Masterclass: An exclusive, limited-capacity online session taught by distinguished pastry chefs based in the United States and France.

  • Recipe: Culinary instructions provided by the platform or instructors, accessible for free to users of the Service.

3. Booking and Payment

3.1 Booking Process: Services, including one-on-one sessions, group workshops (online and in-person), and masterclasses, are booked through our website. Availability is based on the schedule set by each instructor. Masterclasses are limited-capacity and will be filled on a first-come, first-served basis.

3.2 Payment Terms: Payment must be made at the time of booking through our integrated Stripe system. Prices are displayed in USD and EUR, depending on the User's location.

3.3 Instructor Payments: Instructors are independent contractors and will receive payment after each session, workshop, or masterclass.

4. Recipes and Disclaimer of Liability

4.1 Recipe Access: Patisserie Mon Amour provides a selection of recipes, contributed by both the platform owner and the pastry chefs who serve as instructors. These recipes are accessible free of charge through the platform and are available for personal use only.

4.2 User Responsibility for Recipe Preparation: Users acknowledge that they are solely responsible for preparing recipes safely and following any necessary food safety practices.

4.3 Limitation of Liability for Health and Safety: Patisserie Mon Amour and its owners, affiliates, and instructors are not liable for any illness, injury, or adverse reaction resulting from the preparation, handling, or consumption of any recipes accessed through the platform. Users accept all responsibility for health and safety when following these recipes.

5. Disclaimer of Liability for Food Intoxication

Patisserie Mon Amour denies all responsibility for any cases of food intoxication or other adverse health effects that may occur as a result of consuming food prepared during or following any of the services offered, including individual sessions, group workshops, and masterclasses. Users are advised to follow all food safety guidelines and prepare food with the utmost care.

6. Cancellation and Refund Policy

6.1 User Cancellations for Individual Sessions: Users may cancel or reschedule a session up to 48 hours before the scheduled time for a full refund. Cancellations within 48 hours are non-refundable but may be rescheduled under special circumstances, at our discretion.

6.2 User Cancellations for Workshops and Masterclasses: Cancellations for workshops and masterclasses must be made at least 72 hours before the scheduled start time for a full refund. Cancellations made within 72 hours are non-refundable but may be eligible for rescheduling or credit, at our discretion.

6.3 Instructor Cancellations: If an instructor cancels a session, workshop, or masterclass, the User will be offered a choice between a full refund or rescheduling with the same or a different instructor.

7. User Responsibilities

7.1 Preparation: Users are responsible for ensuring they have the required ingredients, equipment, and a stable internet connection before online sessions or workshops. For in-person workshops, Users are responsible for attending on time at the designated location.

7.2 Safety: Users must follow safety instructions provided by instructors. Patisserie Mon Amour is not responsible for any injuries that may occur during an online or in-person session, workshop, or while following a recipe.

7.3 Prohibited Actions: Users may not record, share, or distribute any part of the session, workshop, masterclass, or recipe without the instructor’s and platform’s consent.

8. Instructor Responsibilities

8.1 Professionalism: Instructors are expected to conduct sessions, workshops, and masterclasses professionally, providing clear guidance and high-quality instruction.

8.2 Session Punctuality: Instructors must be available at the scheduled time. Any delays must be communicated to the User promptly.

8.3 Independent Contractor Status: Instructors on Patisserie Mon Amour are independent contractors and not employees. They are responsible for complying with their local tax regulations.

9. Limitation of Liability

Patisserie Mon Amour and its owners, affiliates, and employees are not liable for any personal injury, property damage, or other harm resulting from the sessions, workshops, masterclasses, or from following any recipes provided. The platform is not liable for any technical issues on the User’s or Instructor’s side.

10. Intellectual Property

All content provided by Patisserie Mon Amour, including but not limited to the website design, logo, and promotional materials, is the intellectual property of the platform and may not be used without permission. Unauthorized recording or sharing of session, workshop, masterclass, or recipe content is prohibited.

11. Privacy Policy

We collect and store personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United States of America. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United States of America.

13. Changes to Terms

Patisserie Mon Amour reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the service after such changes constitutes acceptance of the updated Terms.
